 BBQ Rush respects your privacy and is committed to protecting it through our compliance with this policy.

This privacy notice (our “Privacy Notice”) describes the types of information we may collect from you or that you may provide when you visit the website www.bbq-rush.com (our “Website”) (including to place an order), subscribe to our email/ SMS/ MMS programs, and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies to information we collect:

  • When you subscribe to our Email, SMS/ MMS programs

  • In our restaurant or place a Phone In Order

  • If you provide feedback regarding your service experience

If you do not agree with our policies and practices, your choice is not to use our Website or to participate in BBQ Rush’s subscription programs. By accessing or using our Website, by participating in BBQ Rush’s subscription programs, or by placing a Phone In Order, you agree to this Privacy Notice. This Privacy Notice may change from time to time (see Changes to Our Privacy Notice). Your continued use of our Website, or subscription programs, or by placing a Phone In Order after we make changes is deemed to be acceptance of those changes, so please check this Privacy Notice periodically for updates.

 

2.                  CHILDREN UNDER THE AGE OF 13

Our Website and participation in BBQ Rush’s subscription programs are not intended for children under 13 years of age, and we are unable to accept Phone In Orders from children under the age of 13. No one under age 13 may directly provide any information to or on the Website, and no one under age 13 may place a Phone In Order. We do not knowingly collect Personal Information from children under 13. If you are under 13, do not use or provide any information on our Website, or through any of our subscription programs, or place a Phone In Order, including providing your name, address, telephone number or email address. If we learn we have collected or received Personal Information from a child under 13, we will delete that information. 3.                  INFORMATION WE COLLECT ABOUT YOU AND HOW WE COLLECT IT

 

Generally

We collect several types of information from and about users of our Website, and guests who choose to subscribe to our programs (“Personal Information”):

  • By which you may be personally identified, such as first and/or last name, postal address, e-mail address, telephone number, and credit card information (for payment information only)

  • That is about you but individually does not identify you, such as date of birth, wedding anniversary date, gender, order details and history, and other information about your use of our Website and subscription programs; and/or

  • When you place an order in our restaurant;

  • When you place an order for our restaurant with a third party restaurant delivery service;

  • From third party marketing companies;
     

Information You Provide to Us or That We Collect When You Place an Order With Our Restaurant

The information we collect from you is:

  • Information that you provide by filling in forms on our Website. This includes information provided when subscribing to BBQ Rush’s email and SMS/ MMS programs, or requesting more information from us;

  • Information that you provide when placing an order at our restaurant (including Catering Orders), which may include your name, and your address and phone number (for Catering Orders);

  • Details of your orders if you create an account for online ordering or subscription programs and of the fulfillment of your orders. You may be required to provide financial information before placing an order through our Website;

  • Details about your organization if you request BBQ Rush’s support your organization’s fundraising activities, including any information on tax forms submitted to verify your non-profit status;

  • Records and copies of your correspondence (including email addresses), if you contact us;

  • Information that you provide when signing up for a contest or promotion sponsored by BBQ Rush, which may include your name, phone number, email address, and other information requested when you sign up for the contest or promotion;

  • When you provide feedback regarding your experience in our restaurant;

  • Your responses to surveys that we might ask you to complete for research purposes; and

  • When you report a problem with our Website.
     

Information We Collect From Third Parties

We may also collect the following information about you from third parties:

  • When you place an order for menu items from our restaurant through a third party restaurant delivery service, that service may provide us with your contact information and other details of your order; and

  • Information (including Personal Information) about consumers that may have an interest in our products and services that we use to better market our products and services, including through targeted (behavioral) marketing on social media channels.
     

We do not control the third parties’ collection and use of any information provided by these third parties. We handle the information received from these third parties in accordance with this Privacy Notice.

As you navigate through and interact with our Website and Mobile Application or when you visit our restaurant, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns:

  • Details of your visits to our Website. We collect traffic data, location data, logs, referring/exit pages, date and time of your visit to our Website, error information, clickstream data, and other communication data and the resources that you access and use on the Website; and

It helps us to improve our Website and to deliver a better and more personalized service by enabling us to:

We also use Closed Circuit TV cameras to collect images of our guests in our restaurants in order to protect the rights, property, or safety of BBQ Rush’s, and our team members, guests, or others.

We use information that we collect about you or that you provide to us, including any Personal Information:
 

  • To present our Website and their contents to you;

  • To provide you with information, menu items, or services that you request from us;

  • To allow you to subscribe to our programs and receive its benefits;

  • To provide you with notices about your BBQ Rush’s subscription program or online ordering account, including notices about your or order status;

  • If you use our catering services, to contact you via phone about new promotions regarding our catering services;

  • To provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our services;

  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection;

  • To notify you about changes to our Website, subscription programs, online ordering account, or any products or services we offer or provide through them;

  • To fulfill any other purpose for which you provide it;

  • In any other way we may describe when you provide the information; and

We may also use your information to contact you (including through interest-based (behavioral) advertising and other targeted advertising) about our own or third parties’ products and services that may be of interest to you, such as new and limited availability menu items and special offers on menu items and services. We do not share, sell, or otherwise disclose your Personal Information for purposes other than those outlined in this Privacy Notice. However, we may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

  • For any other purpose disclosed by us when you provide the information; and

  • To enforce or apply our Website terms of use, participation rules for BBQ Rush’s subscription programs, terms of sale, and other agreements, including for billing and collection purposes (for corporate accounts); and

This includes exchanging information with other companies and organizations for the purposes of deterring crime, fraud protection, and credit risk reduction.

6.                  CHOICES ABOUT HOW WE USE AND DISCLOSE YOUR INFORMATION
 

We do not control the collection and use of your information collected by third parties described above. When possible, these organizations are under contractual obligations to use this data only for providing the services to us and to maintain this information strictly confidential. These third parties may, however, aggregate the information they collect with information from their other customers for their own purposes.
 

In addition, we strive to provide you with choices regarding the Personal Information you provide to us. We have created mechanisms to provide you with control over your Personal Information:
 

·           Tracking Technologies and Advertising. You can set your browser or your mobile device to refuse all or some cookies, or to alert you when cookies are being sent. However, if you choose to refuse cookies you may be unable to access certain parts of our Website or use our Mobile Application.

·           Promotional Offers from BBQ Rush. If you are a member of BBQ Rush’s subscription program or otherwise have an online account with us, we may use your contact information to promote our own and third parties’ products and services. If we have sent you a promotional email or text, you may click the unsubscribe link at the bottom of that email or text to be omitted from future promotional email and text distributions. This opt out does not apply to emails related to a transaction, such as emails related to a restaurant order or product service experience, or emails related to your relationship with BBQ Rush’s, such as an email to help you reset your password or for us to respond to an email from you.

You can learn more about interest-based advertisements and your opt-out rights and options from members of the Network Advertising Initiative (“NAI”) on its website (www.networkadvertising.org) and from members of the Digital Advertising Alliance on its website (www.aboutads.info). We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can also opt out of receiving targeted ads from members of the NAI on its website.

 

7.                  ACCESSING AND CORRECTING YOUR INFORMATION
 

 

You can review and change your Personal Information by logging into the Website and visiting your “Profile” page. You may also notify us through the Contact Information below of any changes or errors in any Personal Information we have about you to ensure that it is complete, accurate, and as current as possible. We may also not be able to accommodate your request if we believe it would violate any law or legal requirement or cause the information to be incorrect.

Because there is no standard for these signals at this time, we currently do not honor such signals and we do not modify what information we collect or how we use that information based upon whether such a signal is broadcast or received by us.

All information you provide to us is stored on our secure servers behind firewalls. All payment transactions are performed by our third-party payment processor, who must comply with appropriate industry standards to protect your payment information.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the Internet is not completely secure.
